Getting Married in Ontario after a divorce outside of Canada
In order to get married in Canada you must obtain a marriage license. If a person has previously been divorced outside of Canada, the Office of the Registrar General must issue an authorization before a marriage license is issued. The authorization is issued based on an application package, which must include the Foreign Divorce Opinion Letter.
How to get Foreign Divorce Authorization
To get Foreign Divorce Authorization, you will need to send the following documents to Service Ontario:
- marriage licence application form.
- statement of sole responsibility.
- Foreign Divorce opinion letter: from an Ontario lawyer giving reasons why the divorce or annulment should be recognized in Ontario
- divorce decree or annulment: an original or court-certified copy in English or French.

Why do you need a Foreign Divorce Opinion Letter
If you or your partner had previously been divorced outside of Canada, you will need a Foreign Divorce Opinion Letter in order to get married in Canada.
Foreign Divorce Opinion Letter is required to validate the foreign divorce granted outside Canada, so that the person who was divorced outside Canada can remarry in Canada.
How can you get a Foreign Divorce Opinion Letter
1) Book your appointment with one of our Family Law lawyers.
2) Provide the following documents in advance of your appointment:
a. Completed marriage licence application form.
b. Divorce Decree – the original or a certificated true copy from the court granting the divorce.
c. statement of sole responsibility.
d. Confirmation of residency in Divorce Jurisdiction - Your lawyer will need to consider whether at least one of the parties to the divorce was ordinarily resident in the jurisdiction that granted the divorce for a least one year immediately preceding the commencement of the proceedings for the divorce. It needs to be determined whether there was a real and substantial connection between at least one of the parties and the country where the divorce was issued.
